Do you need building consent to build an indoor sauna in Sydney?
NSW doesn't use "building consent" as a term at all. Instead there's Development Consent (approval from your council, or sometimes a private certifier, that the use and built form are appropriate for the site) and a Construction Certificate (confirmation that the actual construction plans comply with the National Construction Code and Australian Standards). For straightforward projects, a Complying Development Certificate can combine both into one faster approval, provided the work meets fixed standards. Sitting outside all of that is a narrow category called exempt development, covering genuinely minor jobs like painting, minor internal alterations, and small external structures, which need no approval at all as long as every condition in the relevant SEPP is met.
The internal alterations exemption is where an indoor sauna gets tested, and it's a tight one. It generally covers work that doesn't touch structural elements and doesn't affect fire safety systems or wet areas. A custom sauna room, framed and lined, with a dedicated electrical circuit for the heater, usually pushes past those limits, mainly because of the new electrical work and the fire safety and ventilation considerations that come with an enclosed heated space. That takes it out of exempt development and into needing at least a Construction Certificate, obtained either through the Complying Development pathway if your project happens to fit those standard criteria, or through a full Development Application and Construction Certificate process with your council if it doesn't.
A prefabricated plug-in sauna cabin that just sits inside a room without structural work is more likely to be treated like an appliance installation and avoid the exempt-development question altogether. The dividing line again comes down to whether the install touches structure, wiring beyond a simple plug-in connection, or wet-area waterproofing.

Do you need building consent to build an outdoor sauna in Sydney?
NSW has a specific exempt development category that covers cabanas, garden sheds, gazebos and similar small backyard structures, and outdoor saunas often get assessed against it. The standard thresholds are:
a floor area of up to 20 square metres,
a height cap of 3 metres,
and a setback of at least 900mm from every boundary.
Two conditions matter most for a sauna: the structure has to stay a non-habitable Class 10 building, and it can't be connected to water or sewerage services. Electricity itself isn't explicitly ruled out by those standards, which is why a lot of the smaller prefabricated sauna pods sold in Australia (the ones under roughly 5 to 10 square metres) are marketed as fitting within this exempt pathway, wired through a licensed electrician on a dedicated circuit, without triggering council approval.
Where this breaks down is custom, built-in-place sauna structures, especially anything that involves plumbing, a shower or cold plunge alongside it, structural attachment to the house, or sits close enough to a boundary or in a heritage, bushfire, or flood-affected area to pull in extra planning controls. Those generally do need either a Development Application through council or, if the design happens to fit a Complying Development Certificate pathway, a CDC plus a Construction Certificate, the same NSW framework covered for the indoor version.
So the practical dividing line in Sydney is closer to: small prefab pod, no plumbing, wired by an electrician, likely exempt if it fits the size and setback limits; anything larger, plumbed, or structurally tied to the house, likely needs approval. Given how much rides on your specific council's interpretation and any overlays on the property, confirming with them before ordering or building is still the safest step.
